The High court on Thursday April 12,2018 gave the ruling that Barrack Muluka will remain the ANC secretary General. His appointment had been nullified by Political Parties Disputes Tribunal but on 12th April the court ruled in his favour.
The parties were ordered to appear for hearing on 19th April .This order was given by Justice Lucy Njuguna.This came after the ANC party Musalia Mudavadi had gone to high court to appeal the decision of tribunal for nullifying his appointment.
Muluka, Mudavadi , Kelvin Lunani and Margaret Ndanyi had filed an application through lawyer Dan Ameyo to grant an interim order of stay PPDT orders. If PPDT orders were to be followed then those who had gone to appeal would suffer injustices and irreparable loses.
Mudavadi and his colleagues say that ANC members ;Angela Gathoni, Nominated MP Godfrey Osotsi and Ibrahim Memba brought a case which was premature before the tribunal.
in addition Mudavadi said that they had not completely exhzusted the internal dispute resolution mechanism which is prescribed in the poilitical parties act of 2011.
